Partner's Terms and Conditions
According to the Information Technology Act of 2000, its regulations as applicable, and the updated provisions relating to electronic records in other statutes as modified by the Act, this document is an electronic record. Rule 3 (1)(a) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021, which mandates the publication of the terms and conditions, privacy statement, and guidelines for accessing or using the www.celibrat.com website and the "Celibrat" application for mobile and handheld devices, is followed in the publication of this document.
The meaning of any capitalised terms that are used but not defined here will be determined by the Terms of Use that regulate how you use our website, www.celibrat.com (the "Website") and our "Celibrat" app for mobile and handheld devices (the "App"). The term "Platform" refers to both the website and the application.
This agreement governs your use of Celibrat's services, which are provided on an as-is and contractual basis. The following provisions outline the terms and conditions of this agreement: the parties' respective warranties, duties, intellectual property rights, confidentiality obligations, responsibilities, and the circumstances under which either party may terminate the agreement.
1. Eligibility
- You must be at least 18 years of age.
- You must be legally permitted to provide event management, decoration, or photography services.
- All information submitted during registration must be true, accurate, and complete.
2. Registration & Profil
- Partners are responsible for maintaining accurate business details, pricing, portfolio, and availability.
- The Platform reserves the right to verify documents, portfolios, and credentials.
- Any false or misleading information may result in suspension or termination.
3. Scope of Services
- Partners agree to provide services as listed on their profile, including online decoration booking, photoshoots, or event-related services.
- Quality of service must meet industry standards and customer expectations.
- Partners must carry their own equipment, staff, and materials unless otherwise agreed with the client.
4. Bookings & Acceptance
- Service requests received through the Platform may be accepted or declined by the Partner.
- Once a booking is accepted, it becomes binding.
- Partners must not cancel confirmed bookings without valid reason.
5. Pricing & Payments
- Prices listed by Partners must be transparent and inclusive of applicable charges unless stated otherwise.
- The Platform may charge a commission or service fee, as communicated separately.
- Payments will be released to Partners after successful completion of the service, subject to Platform policies.
6. Cancellations & Refunds
- Booking cancelled after Confirmed order by service provider: ₹300 charge will apply.
- Booking cancelled before accepted order by service provider: no charge.
- Refunds to customers will be handled as per the Platform’s refund policy.
If the customer cancels the service within 12 hours of the scheduled booking date and time, the service provider will receive 50% of the agreed-upon amount.
If the customer cancels the service within 12-24 hours of the scheduled booking date and time, the service provider will receive 30% of the agreed-upon amount.
If the customer cancels the service within 24-48 hours of the scheduled booking date and time, the service provider will receive 10% of the agreed-upon amount.
If the customer cancels the service more than 48 hours after the scheduled booking date and time, the service provider will not receive any fee from the agreed-upon amount.
The approved refund amount will be deposited within 7 working days.
7. Partner Responsibilities
- Arrive on time and deliver services professionally.
- Maintain proper conduct with customers.
- Comply with all applicable laws, taxes, and local regulations.
- Ensure backup plans for equipment or staff failures.
8. Ratings & Reviews
- Customers may provide ratings and reviews after service completion.
- Partners must not manipulate or attempt to influence reviews.
- Consistently poor ratings may lead to suspension.
9. Intellectual Property
- Partners retain ownership of their content (photos, videos, portfolio).
- By uploading content, you grant the Platform a non-exclusive right to display it for marketing and listing purposes.
10. Confidentiality
- Customer information obtained through the Platform must be kept confidential.
- Partners must not misuse or share customer data for personal marketing without consent.
11. Liability & Indemnity
- Partners are solely responsible for the services they provide.
- The Platform is not liable for service quality, damages, or disputes between Partner and customer.
- Partners agree to indemnify the Platform against any claims arising from their services.
12. Termination
- The Platform may suspend or terminate Partner accounts for policy violations, misconduct, or non-performance.
- Partners may request account deactivation with prior notice.
13. Modification of Terms
- The Platform reserves the right to modify these Terms & Conditions at any time.
- Continued use of the Platform after changes implies acceptance.
14. Governing Law
- These Terms shall be governed by and interpreted in accordance with the laws of India.
